Welcome to WithholdRight (the "Site"), operated at 1an.site (referred to as "WithholdRight," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By accessing, browsing, or otherwise using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. These Terms constitute a legally binding agreement between you and WithholdRight. If you are using the Site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We may revise these Terms at any time by posting an updated version on this page. The "Last updated" date at the top reflects the most recent revision. Your continued use of the Site after any change constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Description of Service

WithholdRight provides a free, web-based multi-state tax withholding calculator and an informational content library covering U.S. federal, state, and local tax rules relevant to remote employees and multi-state employers. The Site is intended for general informational and educational purposes only. Specifically, the Site offers:

  • An interactive calculator that estimates federal income tax, FICA, state income tax, local taxes, and net pay for employees who live in one state and work for an employer in another.
  • A library of in-depth articles on topics including state reciprocity agreements, the convenience of the employer rule, employer nexus, state unemployment insurance, and state-specific tax guides.
  • Reference pages including a methodology document, a 50-state tax bracket reference, and editorial standards.

The Site is provided at no cost. We do not require registration, account creation, or payment to access the calculator or the article library.

3. No Professional Advice

The Site and all content available through it — including the calculator outputs, articles, examples, FAQs, and any other material — are provided for general informational purposes only and do not constitute, and should not be relied upon as, tax, legal, accounting, investment, or other professional advice. The calculator produces estimates based on published rates and standard assumptions; it does not account for every factor that may affect your individual tax situation.

You should consult a qualified tax professional, certified public accountant (CPA), enrolled agent (EA), or attorney licensed in your jurisdiction before making any tax-related decision, including but not limited to filing returns, adjusting withholding, claiming credits, structuring employment, or relocating across state lines. WithholdRight does not provide personalized advice and no communication between you and WithholdRight creates a professional-client relationship.

For the complete statement of limitations, see our Disclaimer, which is incorporated into these Terms by reference.

8. Disclaimers and Limitation of Liability

8.1 No Warranty

The Site and all content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of dealing. We do not warrant that the Site will be uninterrupted, error-free, secure, or that defects will be corrected.

8.2 Accuracy of Tax Data

While we use commercially reasonable efforts to ensure that the tax rates, brackets, and rules displayed on the Site are accurate and current as of the date of publication, tax law changes frequently. We do not warrant that any specific rate or rule is current, complete, or applicable to your situation. Always verify against primary sources (IRS publications, state DOR websites) or consult a tax professional.

8.3 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall WithholdRight, its officers, directors, employees, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, business interruption, or any other commercial damages or losses, arising out of or related to your use of, or inability to use, the Site or its content, even if we have been advised of the possibility of such damages.

8.4 Aggregate Liability Cap

Our aggregate liability for any claim arising out of or relating to the Site or these Terms, regardless of the form of action, shall not exceed the greater of (a) the amounts you have paid us, if any, in the past 12 months, or (b) USD $100.00.

9. Indemnification

You agree to indemnify, defend, and hold harmless WithholdRight, its officers, directors, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses — including reasonable attorneys' fees — arising out of or relating to your breach of these Terms, your violation of any law or the rights of any third party, or your misuse of the Site.

10. Geographic Restrictions

The Site is intended for users located in the United States. The tax rules discussed are U.S. federal, state, and local rules. If you access the Site from outside the United States, you do so at your own initiative and are responsible for compliance with local laws. We make no representation that the Site is appropriate or available in any location outside the United States.

11. Termination

We may suspend or terminate your access to the Site at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, all provisions of these Terms which by their nature should survive — including ownership, indemnification, disclaimer of warranty, and limitation of liability — shall continue to apply.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which WithholdRight is operated, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in the United States, and you consent to personal jurisdiction and venue in those courts.

Before filing any claim, you agree to first contact us at contact@1an.site and attempt to resolve the dispute informally for a period of 30 days.

13. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' intent.

14. Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, and Advertising Disclosure, constitute the entire agreement between you and WithholdRight with respect to the Site and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
